1. Introduction

This Agreement is a legal document, which sets out your rights and obligations, and those of Rewards4Golf ("we", "us" or "Rewards4Golf"), in relation to the Rewards4Golf website, the Rewards4Golf mobile app (if applicable) and the Rewards4Golf Points Reminder and the services offered by us through applications (the "Rewards4Golf Service"). You must take the time to read and understand this Agreement before registering for the Rewards4Golf Service. By registering, you accept that you are entering into a contract with us on the terms of this Agreement. You should be aware that this Agreement may change from time to time in accordance with Clause 21 below.

When you register for the Rewards4Golf Service we establish an "Account" to which any Rewards4Golf points you earn are credited and you become a "Member" of the Rewards4Golf Programme.

2. The Rewards4Golf Service

The Rewards4Golf Service allows you to earn points from tracked purchases from our retail and partner network which can be used to gain a discount on your next golf purchase (whether that is a new driver, putter, golf glove, golf balls or golf holiday) with our redemption partners.

Our help pages and other service documentation available on the Rewards4Golf website, the Rewards4Golf mobile app (if applicable) and the Rewards4Golf Points Reminder provide further information about our service; you should consult them concerning queries or issues you may have about the Rewards4Golf Service.

3. Obtaining an Account

You must be at least 18 years of age to obtain an Account. You may have no more than one Account. You must be a resident of the UK or Republic of Ireland to register for a Rewards4Golf Account.

You must register for the Rewards4Golf Service using accurate and current information about yourself - including your correct name, email address and any other requested details. You should keep this information updated through your Account.

Important: You must ensure that the email address we hold for you is kept up-to-date and that you have full access to it - we will be sending you important messages there. If you change email address, then you must change the address we hold for you on your Account. To do this, please contact our customer service team at hello@rewards4golf.com.

On acceptance of your registration, you will be allocated a Member's Account. You will be able to monitor the balance of your Rewards4Golf points by logging in to your account online or via your mobile device.

Once you have created an Account with us, as a Member, you will also start to receive email communications from us in relation to the benefits of membership:

  • Points earning opportunities with our Retail Partners and Betting Partners.
  • Points earning opportunities with our other programme partners.
  • Points earning opportunities with other third parties which we think you'll be interested in.
  • Exciting and relevant competitions and promotions that we are running for Members.
  • Regular newsletters about the Rewards4Golf programme as well as Member exclusive offers.
  • Fantastic opportunities to spend your points with the Rewards4Golf redemption partners.

We also use cookies and similar technologies, such as tags and pixels, to personalise and improve your member experience as you use our website, mobile app (if applicable) and Points Reminder and to provide you with relevant online advertising. Therefore, as a Member, you may also receive relevant advertising on third party websites (for example on Facebook, Google and Twitter) about points earning opportunities with our partners as well as relevant content about the Rewards4Golf programme. Only one registration or account per person will be accepted. We reserve the right to close multiple accounts registered by the same person and to cancel Rewards4Golf points collected on such accounts at our discretion.

We reserve the right to vary or cancel any special incentives (such as free or promotional Rewards4Golf points) without notice.

We reserve the right to suspend or terminate your Membership and/or cancel Rewards4Golf points collected at any time for any good reason, e.g. if you breach the terms in this Agreement.

4. Earning Rewards4Golf points

4.1 Earning Rewards4Golf points - Generally

To qualify for Rewards4Golf points, our Retail Partners and our Betting Partners must confirm that your purchase is tracked, genuine and successful (constituting a "Qualifying Transaction"), and your resulting referral fee must be received by us (becoming Rewards4Golf points as a result). When we refer to our Retail Partners and our Betting Partners, we mean sellers and suppliers of goods or services and other businesses that work with us.

After you successfully complete a Qualifying Transaction, the Rewards4Golf points relating to that transaction may remain as pending on your Account until the resulting referral fee has been paid. Once the referral fee has been paid, the relevant Rewards4Golf points will be available for you to use. Please view your Account statement for further information on when your Rewards4Golf points are likely to be available for you to use.

Please note that there are various circumstances in which an online transaction with one of our Retail Partners may not constitute a Qualifying Transaction or a referral fee may not result from it. Our FAQ's provide further information about these circumstances.

There are various circumstances in which a referral fee with one of our Retail Partners will not be payable, and Rewards4Golf points will not be allocated to you, and will be forfeited to us, namely:

a. the transaction to which the referral fee relates is cancelled after it has been entered into (whether under the right of cancellation that applies to some sales made at a distance, or otherwise);

b. your Account has been:

(i) suspended by us under Clause 7 or Clause 11 of this Agreement;
(ii) associated with any fraudulent activity or any breach of this Agreement;
(iii) used to make purchases on behalf of, or for the benefit of, any other person.

4.2 Earning Rewards4Golf points with our Betting Partners

In order to be eligible to receive Rewards4Golf points from your betting activity with any of our Betting Partners (either in relation to new registrations with a Betting Partner or from transactional betting activity with a Betting Partner), you must have:

1. activated your Account with Rewards4Golf; and
2. directly logged-in to your Account during the week in which you either register and open an account with the relevant Rewards4Golf Betting Partner or place a bet with the relevant Rewards4Golf Betting Partner.

A direct login by you is defined as:

1. visiting the Rewards4Golf website and manually inputting your email address and password; or
2. logging-in to your Rewards4Golf account via Facebook.

Clicking through from a Rewards4Golf marketing email (and consequently being auto logged-in by that email) will not constitute a direct log-in for the purposes of collecting points from your betting activity with our Betting Partners (unless you have clicked through to the website via a specific 'Claim my Points' betting related email).

5. Card Registrations

By registering the number of your credit card and/or debit card and/or charge card ("Identifier Card Numbers") in the Rewards4Golf programme, you hereby authorise us to disclose your Identifier Card Numbers to our In-store Retailers or their suppliers (even if you never use the Identifier Card Numbers with one or more of those retailers) to identify and calculate any Rewards4Golf points entitlement you might have and otherwise as appropriate in accordance with the terms of our Privacy Policy and acknowledge that we shall collect any and all information from any retailer, merchant acquirer, credit card processor, issuing bank, or any other available source with respect to the purchases made using your Identifier Card Numbers. You represent that with respect to each Identifier Card Number that you have provided that you are entitled to register that card number and receive information about the transactions effected using such cards.

You may only register a maximum of 5 Identifier Card Numbers per Account, however this may include cards belonging to other members of your household/family providing that they have consented to the registration of their Identifier Card Number(s) to assist you to collect Rewards4Golf points. We may request that you provide written evidence of such consent at any time. If we are not satisfied that all Identifier Card Numbers are included with the holder's consent we reserve the right to de-register any or all Identifier Card Numbers on your Account.

Each Identifier Card Number may only be registered at any one time to one service in the world through which cards are used as identifiers for the purpose of crediting rewards (whether Rewards4Golf points or other kinds of rewards) when shopping with designated retailers. In the event of more than one attempted registration of the same Identifier Card Number the last registration will prevail and previous registrations will be automatically de-registered.

Within a period of six months after earning Rewards4Golf points when shopping with any of our In-store Retailers using your Identifier Card Number(s) you must log-in to your Account to activate these points and ensure that they are available for use. If you do not log-in to your account within this six-month period, then the Rewards4Golf points earned in-store with the relevant retailer(s) will be cancelled and cannot be used.

6. Redemptions & Rewards

You can spend your Rewards4Golf points by redeeming for a voucher of your choice from the selection of golf retailers listed on the Spend Points page of the Rewards4Golf website.

From the drop down menus, you can choose both the golf retailer and the amount of the voucher you want to redeem for (voucher denominations start at £5 with the golf retailers featured on these pages of the website).

Within 5 working days of you redeeming your Rewards4Golf points, we will send your voucher by email to the email address listed on your account. Remember: 200 Rewards4Golf points = £1 to spend on vouchers with the golf retailer of your choice. Please note that Foremost Golf vouchers are posted to the address listed on your Rewards4Golf account and can take up to 10 working days to arrive.

Once you have redeemed your points and received your voucher, you can then use the voucher when making your next purchase with your chosen golf retailer. No representations are made by us regarding the quality of products or services supplied by any golf retailers with whom you redeem your vouchers.

Please note that vouchers issued by the golf retailers featured on the Rewards4Golf website are subject to each retailer's own terms and conditions of use.

Rewards4Golf points that are not shown as 'available' on your Account statement cannot be used, inter alia, until they have been paid by the relevant retail partner who is responsible for them.

From time to time, we may also publish additional rewards on the Rewards4Golf website or mobile app (if applicable).

If you have breached the terms in this Agreement, or for any other good reason, we may refuse to process an order for rewards.

The sale or transfer of Rewards4Golf points to another person or Member's Account is not permitted without our consent.

7. Account and Programme Suspension or Termination & Dormant Accounts

If the Rewards4Golf programme is suspended or terminated for any reason:

a. we will make every effort to contact you, via your nominated email address, to let you know;
b. we will provide a reasonable period to allow you to spend your Rewards4Golf points;
c. after this period has expired, your Account will be closed, no further redemptions will be possible and any residual Rewards4Golf points balances will be cancelled. The period will be made clear on the website or mobile app (if applicable) at the time of any decision to terminate or suspend the Rewards4Golf programme.

If for any period of thirteen months you do not log-in to your Rewards4Golf Account, then the status of your Account will be amended to a 'Dormant Account'.

We reserve the right to remove and cancel any Rewards4Golf points from any Account that has been classified as a Dormant Account. We will make every effort to contact you, via your nominated email address, to let you know that your Rewards4Golf points are at risk of being deleted through Account inactivity. If a reply is received confirming that the Account is still active we will continue to maintain the Account. In the absence of a satisfactory response, the Rewards4Golf points associated with the Dormant Account will be removed and cancelled.

You may request that your Account is deleted at any time by contacting us at hello@rewards4golf.com.

8. Intellectual Property

By uploading or including any material on the Rewards4Golf Service, you expressly grant:

a. to us a non-exclusive licence (including the right to grant sub-licences) to use, reproduce and distribute that material through the Rewards4Golf Service and any other interactive services through which we or our sub-licensees make the Rewards4Golf Service (or a service based on the Rewards4Golf Service) available; and

b. to other Members (through us, under the licence referred to in a. above), the non-exclusive, personal, non-transferable right to view the relevant material.

You acknowledge that all copyright, trademarks and other intellectual property rights in and relating to the Rewards4Golf Service (including the material which is contributed by Members or retailers) are owned by, or licensed to, us. It is easy to copy material which appears on websites, but this does not mean it is legal. Therefore, you may not copy, distribute, show in public or create any derivative work from the Rewards4Golf Service, or any of the material which is found on the Rewards4Golf Service unless properly licensed to do so by us.

9. Privacy Policy

It's important to us that you understand how we keep your personal information safe, whilst giving you the best possible experience with the Rewards4Golf Service. Please do review our Privacy Policy to find out more about how we collect, use, disclose, transfer and store your personal information.

Given the global nature of the World Wide Web, please note that a posting on the Rewards4Golf Service may be accessible to internet users around the World.

10. Our Role

Rewards4Golf is not a party to any transactions by you with our Retail Partners or our Betting Partners and is not the seller or supplier of any of the goods or services that they make available. Therefore, we do not have any of the legal obligations that apply to the providers of those goods or services.

Accordingly, we have no control over or responsibility for:

a. the quality, safety, or legality of goods or services available from our Retail Partners or our Betting Partners; or

b. whether our Retail Partners or our Betting Partners can or will supply and pass good title to any goods or services.

You should exercise no lesser degree of caution in entering into transactions with our Retail Partners or our Betting Partners than you would when entering into a similar transaction offline.

To the extent that the law permits, you release us, our agents and employees from all liability arising out of or in connection with any transactions with our Retail Partners or our Betting Partners, including (without limitation) all claims and demands relating to uncompleted or completed transactions with those partners, or goods or services offered for sale or supply, or actually sold or supplied, through or in connection with any transactions with those partners.

11. Misuse

We reserve the right to suspend or terminate your access to the Rewards4Golf Service, or parts of it, if in our reasonable view you appear to be in breach of any provision of this Agreement.

Your Account should only be used for purchases made by you, and not on behalf of, or for the benefit of, any other person(s).

You must not enter into, or attempt to enter into, any transaction with our Retail Partners or our Betting Partners to gain Rewards4Golf points (a) by providing someone else's personal information, or a payment method which you are not entitled to use, (b) by deceptively or unfairly exploiting an offer by one of our Retail Partners or our Betting Partners, or (c) in breach of any terms and conditions applied by us or by a Retail Partners or a Betting Partners who is a party to that transaction.

It is your obligation to ensure that any material posted by you on the Rewards4Golf Service or associated with your Account:

a. is not defamatory, offensive, or abusive or of an obscene, indecent or menacing nature;

b. is not intended or likely to cause needless annoyance, inconvenience or distress to any person;

c. does not contain any computer virus, macro virus, Trojan horse, worm, or anything else designed to interfere with, interrupt, or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority, or expropriate any system, data or personal information;

d. does not contravene any applicable law or regulation (including, but not limited to, laws governing consumer protection, distance selling, unfair competition, anti-discrimination, false advertising, copyright, trademark and privacy);

e. does not breach the rights of any person or entity (including any rights or expectations of privacy)

f. where it constitutes feedback on one of our Retail Partners or our Betting Partners, is accurate and fair; and

g. does not advertise any goods or services. If you see or experience anything on the Rewards4Golf Service that appears to infringe any of the above requirements, we would like you to inform us by emailing hello@rewards4golf.com. You acknowledge that we are entitled, but not obliged, to withdraw any material, which appears - based on information received from third parties or other Members - to be in breach of this Agreement.

12. Use of the Website, App and Points Reminder and User Generated Content

The Rewards4Golf website, mobile app, Points Reminder and the Rewards4Golf Service are for personal and non-commercial use only. You may copy electronically and print portions of the website, mobile app, Points Reminder and/or the Rewards4Golf Service for your personal, non-commercial use only. In particular, you may not use any information or other listing made available on or by the website, mobile app or Points Reminder and/or the Rewards4Golf Service, in connection with any business or commercial undertaking (whether or not for profit). You must not display the website, mobile app or Points Reminder or the Rewards4Golf Service or any part thereof in public. Any other use of materials on the website, mobile app, Points Reminder and/or the Rewards4Golf Service, including User Generated Content (including without limitation reproduction for a purpose other than that noted above and any modification, distribution or republication) without our prior written permission is strictly prohibited. You also agree not to deep-link and/or frame to any of the website, mobile app or Points Reminder for any purpose, unless specifically authorised by us to do so.

You agree that:

a. you will not use the website, mobile app or Points Reminder or the Rewards4Golf Service to transmit or knowingly or recklessly receive (or knowingly or recklessly authorise or permit any other person to receive or transmit) material which is obscene, threatening, menacing, offensive, defamatory, abusive, in breach of confidence, in breach of any intellectual property right (including copyright) or otherwise violates any applicable law or regulation or code, or which makes excessive demands for bandwidth or contains any virus or which may otherwise impair or harm our computer systems or any third party computer system; and

b. you will keep your password(s) if any relevant to the website, mobile app or Points Reminder and/or the Rewards4Golf Service secure and not let them become public knowledge or be used by any third party.

You agree that you will not submit any material to us ("User Generated Content"):

a. that is in any way, threatening, abusive, offensive, defamatory, invasive of another's privacy, in breach of confidence or privacy, embarrassing to any person, hateful, blasphemous, pornographic, or racially, ethnically or otherwise objectionable;
b. in respect of which you do not have the necessary licences or approvals;
c. which constitutes or encourages conduct that would be considered a criminal offence or otherwise contrary to any law, regulation or code of practice, give rise to civil liability or infringe the rights of any third party;
d. which is technically harmful;
e. which is or may be deemed to be advertising or promotional materials;
f. which may collect or store other users' personal data.

You will not impersonate any person or entity when submitting User Generated Content or misrepresent any affiliation with any person or entity.

You acknowledge that we have no obligation to monitor any User Generated Content but we have the sole discretion to display or delete any such User Generated Content in our sole discretion and may remove any such material at any time. Notwithstanding this, you are solely responsible for and bear the risk associated with such User Generated Content, including any reliance on the accuracy, completeness or usefulness of the same.

In the event that you are in breach of this Agreement and/or our standards for User Generated Content at any time, we may suspend or terminate any account that you have with us. You may not open another account with us and if you do, we reserve the right to terminate any such account. In the event that you continue to contravene this Agreement and/or the standards for User Generated Content we reserve the right to contact your internet service provider.

We will co-operate with law enforcement or regulatory authorities or any court order requesting or requiring us to disclose the identity or location of anyone who has submitted User Generated Content to us in breach or allegedly in breach of this Agreement and/or our standards for User Generated Content.

In relation to any User Generated Content, you automatically and hereby grant to us a perpetual, royalty free, irrevocable, non-exclusive right and licence to use, edit, reproduce, modify, publish, translate, create derivative works from and distribute such User Generated Content, in whole or on part, in any form, medium or technology now known or hereafter developed. In addition, as between you and us, you waive any and all moral rights in such User Generated Content.

Please also see our standards for User Generated Content which are incorporated into this Agreement. In the event that you submit any material to us for publication, you will be deemed to have accepted this Agreement and the standards for User Generated Content.

If you see on the website, mobile app or Points Reminder and/or the Rewards4Golf Service any material submitted by a third party user of the website, mobile app or Points Reminder which you believe to be in breach of this Agreement and/or the standards for User Generated Content, you may report it by sending an email to hello@rewards4golf.com. We cannot guarantee that any action will be taken as a result of your email.

13. Contact from Third Parties

If anyone contacts us in relation to material or transactions associated with you or your Account, then you agree:

a. to provide all reasonable information and assistance we may require in connection with responding to that contact; and

b. to respond promptly and accurately to it, should we pass the message to you for a response.

14. Additional Services

We or our partners may offer new or additional services through the Rewards4Golf Service from time to time. Your use of those services may be subject to additional terms and conditions, which you must comply with. Provided that those terms are notified to you on the Rewards4Golf Service in an appropriate manner (as determined by us in our reasonable discretion) when you agree to take those services, any failure by you to comply with a material provision of the terms governing those services will amount to a breach of this Agreement.

15. Operation of the Rewards4Golf Service

We reserve the right to withdraw, modify or suspend aspects of the Rewards4Golf Service, or the entirety of it, where we have legal, security, technical or commercial reasons to do so. We will give you a reasonable period of notice before taking such action, except where it is necessary to take earlier action for security reasons or because of technical difficulties which would otherwise adversely affect the Rewards4Golf Service. There may also be times when the Rewards4Golf Service becomes inaccessible as a result of technical difficulties experienced by Rewards4Golf or on the Internet; we will, however, use reasonable skill and care to overcome these difficulties where they are within our control. Please note, however, that we cannot guarantee continuous access to the Rewards4Golf Service or any of the content that appears on it.

Nevertheless, we will strive to ensure that any periods of planned unavailability, which you will be informed of when you access the Rewards4Golf Service at the relevant time, are kept to a minimum.

For security or other reasons, we may require you to change password or other information which facilitates access to the Rewards4Golf Service; however, we will never ask you for your password via email, telephone, or any other means other than through www.rewards4golf.com. You are solely responsible for maintaining the confidentiality of your password and any additional identifying information.

16. Refer a Friend Promotion Terms and Conditions

By participating in the 'Refer a Friend' promotion, you agree to be bound by the specific terms and conditions relating to the promotion which can be viewed here

17. Liability

a. We warrant that the Rewards4Golf Service will be provided with reasonable care and skill with the intention of meeting our specifications for the Rewards4Golf Service, but we cannot and do not guarantee that the Rewards4Golf Service will meet your requirements.

b. We shall only be liable as expressly provided for in this Agreement, but shall have no other obligation, duty or liability whatsoever in contract, tort (including negligence, breach of statutory duty and any other tort) or otherwise.

c. Nothing in this Agreement shall exclude or restrict our liability for death or personal injury resulting from our negligence.

d. Subject always to sub-clause e. below, we shall be liable for direct loss or damage only, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise, and whether caused by our acts or omissions or those of our employees, agents or subcontractors. Our aggregate liability during any successive period of twelve months, the first of which shall be deemed to begin on the date when you obtain your Account, shall be limited to the Rewards4Golf points payable to you by us in respect of that twelve-month period (but without limiting our obligation to pay Rewards4Golf points to you to the extent provided in this Agreement).

e. We will not be liable to you or anyone else, whether in contract, tort (including negligence, breach of statutory duty or other tort) or otherwise:
i. for any loss of revenue, business, anticipated savings or profits, or
ii. for any indirect, special or consequential loss damage, costs or other claims, howsoever caused or arising, whether through non-supply or late supply of the Rewards4Golf Service or other non-performance of this Agreement or otherwise.

f. Except as expressly stated elsewhere in this Agreement, all representations, warranties, conditions and other terms, whether express or implied (by common law, statute, collaterally or otherwise) are hereby excluded, except in the case of fraud, or where such exclusion is not permitted by law.

g. For the avoidance of doubt, we will not have liability to you or any other person in respect of material contributed by Members, transactions (or non-transactions) with one of our Retail Partners or our Betting Partners, or any activity or communication relating to such material or transactions.

h. The provisions of this Clause 17 shall survive the termination or expiry of this Agreement.

18. Indemnity

You agree to indemnify us against all liabilities, claims and expenses that may arise out of or in connection with (a) any breach of this Agreement by you or through your Account, or (b) any transaction with one of our Retail Partners or our Betting Partners.

19. Assignment

We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement but will not do so in such a way as to reduce any guarantees you are given under this Agreement. You may not without our written consent assign or dispose of this Agreement, nor subcontract any of your rights and obligations under it.

20. Entire Agreement

This Agreement is intended to contain your entire agreement with us relating to the Rewards4Golf Service; we believe it to be fair and reasonable. It replaces all earlier agreements and understandings with you relating to the Rewards4Golf Service, except for any fraud or fraudulent representation by either of us.

21. Changes to this Agreement

We reserve the right to change this Agreement from time to time and post the new version on the Rewards4Golf Service. When we do so, we will post the new version of the Agreement on the Rewards4Golf Service, and the new version of these terms and conditions will take effect, and will govern the Rewards4Golf Service and your relationship with us:

a. commencing no less than thirty days after the date of posting (or such later date as we indicate in the relevant posting), if any of the changes is to an operative provision of this Agreement which is capable of adversely affecting you; if you do not wish to be governed by the new version of the Agreement, you may notify us on or before the date when the new version of the Agreement is to take effect, and from that date you must cease to use the Rewards4Golf Service; or

b. immediately on the date of posting (or such later date as we indicate in the relevant posting), if the changes are not to operative provisions, or not capable of adversely affecting you - examples of which would include, without limitation, changes to contact details referred to, or the refinement of provisions that are already included, in this Agreement.

22. General

In the event that any term of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement shall remain valid and enforceable. You and Rewards4Golf are independent contractors, and no agency, partnership, joint venture or employee-employer relationship is intended or created by this Agreement. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches.

23. Law

This Agreement, and our relationship with you, is governed by the laws of England and Wales.

You and we each submit to the non-exclusive jurisdiction of the English courts in relation to disputes arising in connection with this Agreement.

24. Keeping this Agreement

We don't separately file individual Agreements when Members register for the Rewards4Golf Service. You can access the Agreement at any time by visiting https://www.rewards4golf.com/terms. Please make a durable copy of this Agreement by printing and/or saving a downloaded copy on your own computer. It is offered in English only.

25. Contact

Please note that all communications (including formal notices) under this Agreement must be sent and received by email. For this purpose, your notices should be sent to the following email address hello@rewards4golf.com and we will send our notices to you at the email address you notify to use when you register as a Member, as changed subsequently in your Account details.
